Welcome to Sumter County Patriot Hall.
These Terms of Use ("Terms") govern your access to and use of the Sumter County Patriot Hall website, online services, user accounts, event listings, ticketing features, forms, digital content, communications, and other services made available through or in connection with www.sumterpatriothall.com (the "Site").
These Terms also contain provisions applicable to ticket purchases, event attendance, facility inquiries, and certain other interactions with Patriot Hall.
Sumter County Patriot Hall ("Patriot Hall," "we," "us," or "our") is a public cultural, performing arts, event, meeting, educational, and community facility operated as part of Sumter County Government, South Carolina.
By accessing or using the Site, creating an account, submitting an online form, purchasing a ticket, registering for an event, or affirmatively accepting these Terms when requested, you acknowledge that you have read and agree to these Terms.
If you do not agree to these Terms, you should not use website features that require acceptance of them.

Patriot Hall hosts and supports activities including, but not limited to: concerts; theatrical productions; performing arts; cultural programming; educational programs; workshops; school and youth programs; community activities; exhibitions; meetings; conferences; weddings; receptions; private events; public events; facility rentals; film screenings; camps; presentations; and other authorized activities.
Different events and services may be operated directly by Patriot Hall, jointly with another organization, or independently by a renter, promoter, producer, performer, school, nonprofit organization, government entity, or other third party.
2. Scope of These Terms
These Terms apply to the Site and online services operated or controlled by Patriot Hall.
Certain transactions or activities may also be subject to additional terms, including: ticket-specific conditions; event-specific rules; rental agreements; facility-use agreements; registration terms; refund policies; participation agreements; vendor agreements; performer agreements; school or group agreements; photography or media notices; third-party service terms; and other written agreements.
If a specific written agreement with Sumter County or Patriot Hall conflicts with these general Terms concerning the same subject matter, the more specific written agreement will control to the extent of the conflict. A Patriot Hall facility rental agreement, for example, may impose responsibilities on a renter that are not contained in these website Terms.
3. Privacy Policy
Use of the Site and Patriot Hall's services is also subject to the Sumter County Patriot Hall Privacy Policy.
The Privacy Policy explains how Patriot Hall may collect, use, retain, disclose, and protect information. Because Patriot Hall operates as part of Sumter County Government, information submitted through the Site or otherwise provided to Patriot Hall may constitute a governmental public record and may be subject to South Carolina public-records and records-retention requirements.
Users should review the Privacy Policy before submitting personal information.
4. Eligibility and Authority
You may use the Site only in compliance with applicable law and these Terms.
If you are using the Site on behalf of a business, school, nonprofit organization, government agency, company, event producer, renter, or another organization, you represent that you are authorized to act on behalf of that organization with respect to the action you are taking.
If you are under 18, you should use transaction-related features such as ticket purchasing or facility inquiries with the involvement or authorization of a parent, legal guardian, or other authorized adult when appropriate.
5. Website User Accounts
Patriot Hall may provide account or member functionality. Account features may allow users to perform activities such as: purchase tickets; view event information; maintain contact information; review certain transaction information; manage registrations; receive communications; access member features; or use other services made available through the Site.
You are responsible for: providing accurate account information; maintaining the confidentiality of your password; protecting access to your account; keeping your contact information reasonably current; and promptly notifying Patriot Hall if you believe your account has been compromised.
You may not knowingly permit another person to impersonate you through your account. You may not create an account using false information for the purpose of fraud, deception, abuse, or circumvention of Site restrictions.
Patriot Hall may suspend, restrict, or terminate account access when reasonably necessary to: protect the Site; protect users; investigate suspected fraud; address misuse; comply with law; enforce these Terms; or protect Sumter County systems.
6. Electronic Communications
When you interact electronically with Patriot Hall, you consent to receive communications electronically where permitted by law. These communications may include: ticket confirmations; receipts; account notices; event information; rental communications; registration confirmations; customer-service responses; cancellation notices; postponement notices; rescheduling notices; refund information; policy notices; and other transaction-related information.
Electronic communications may be delivered by email, through the Site, through your account, or through another method associated with the service.
Optional promotional email or messaging is addressed separately in the Privacy Policy.
7. Accuracy of Information You Provide
You agree to provide information that is accurate to the best of your knowledge when completing a transaction, creating an account, submitting a rental inquiry, registering for a program, or otherwise interacting with Patriot Hall.
You should not intentionally provide: false contact information; fraudulent payment information; false organizational credentials; materially misleading rental information; another person's identity without authorization; or information intended to circumvent Site or event restrictions.
Patriot Hall may request additional information when reasonably necessary to verify a transaction, rental inquiry, account, or other request.
8. Accuracy of Website Content
Patriot Hall attempts to provide accurate and current information. However, website information may occasionally contain: typographical errors; outdated information; incorrect dates; pricing errors; technical errors; incomplete information; temporary inconsistencies; or other mistakes.
Event schedules, performers, programs, prices, room availability, capacity information, services, operating hours, and other information may change. Patriot Hall reserves the right to correct website information when an error is discovered.
The appearance of information on the Site does not create a contractual obligation except where Patriot Hall expressly enters into a transaction or written agreement.
9. Website Availability
Patriot Hall does not guarantee that the Site or every website function will be continuously available. Website access may be temporarily interrupted because of: maintenance; software updates; security incidents; vendor outages; internet failures; payment-service interruptions; technical problems; emergency circumstances; or other conditions outside Patriot Hall's reasonable control.
Patriot Hall may modify, suspend, replace, or discontinue website functionality when necessary.
10. Event Information
Patriot Hall publishes information concerning upcoming events. An event page may include: event name; date; time; location; performer or presenter; ticket price; ticket type; seating information; event description; age recommendations; accessibility information; event-specific rules; refund information; and other details.
Event information is subject to change. Users should review the applicable event page and any communications received from Patriot Hall before attending.
11. Events Presented by Third Parties
Not every event occurring at Patriot Hall is produced by Patriot Hall. Events may be produced, promoted, rented, sponsored, or presented by independent third parties.
A third-party event organizer may be responsible for matters such as: programming; performers; event content; event schedules; production decisions; merchandise; vendor activities; performer appearances; event-specific policies; or other aspects of the event.
Patriot Hall's role may be limited to providing the facility and certain venue services. Where Patriot Hall itself is the presenter, the applicable event page or promotional material may identify Patriot Hall as such.
12. Ticket Purchases
Tickets may be offered through the Site or another authorized sales channel. By completing a ticket transaction, you agree to pay: the stated ticket price; applicable service fees; applicable taxes, if any; and other charges disclosed before completion of the transaction.
Your ticket purchase is not complete until the payment transaction has been successfully processed and the order has been accepted. A confirmation screen, confirmation email, electronic ticket, account record, or similar notification may serve as evidence of the transaction.
13. Payment Processing
Patriot Hall uses Stripe to process applicable online payments. Payment information submitted during checkout may be provided directly to Stripe or processed through technology integrated with Stripe.
Use of Stripe services may also be subject to Stripe's applicable terms and privacy practices. Patriot Hall does not intend to independently store complete payment-card numbers or card security codes when payment credentials are submitted directly to Stripe.
14. Pricing and Service Fees
Ticket prices and applicable service fees will generally be displayed before a purchase is completed. Prices may vary based upon: event; ticket category; seating area; admission level; promotion; package; age category; group program; or other event-specific conditions.
Patriot Hall reserves the right to establish or modify prices for tickets that have not yet been purchased. A later increase or decrease in ticket price does not automatically create a right to an adjustment on a previously completed purchase.
15. Pricing and Transaction Errors
If Patriot Hall discovers a material pricing, inventory, technical, or transaction error, Patriot Hall may take reasonable corrective action, including: correcting the error; contacting the purchaser; canceling an erroneous transaction; issuing an appropriate refund; reissuing a ticket; adjusting inventory; or taking another reasonable action.
Patriot Hall will not intentionally enforce an obviously erroneous price created by a technical or publishing mistake.
16. Ticket Availability
Ticket availability is not guaranteed until a transaction is successfully completed. Tickets may sell out while a user is browsing or completing checkout.
Patriot Hall may establish capacity limits based upon: seating; fire and safety requirements; event configuration; accessibility needs; production requirements; temporary holds; event-specific limitations; or other operational considerations.
17. Electronic Tickets and Admission Credentials
A ticket or other admission credential may contain a barcode, QR code, order identifier, or other unique information. Do not publicly post or distribute the scannable portion of a valid ticket. A copied or duplicated ticket may result in multiple people presenting the same credential.
When a unique admission credential is used, only the credential recognized as valid by the applicable admission system will be accepted. Patriot Hall is not responsible for a ticket being copied or used by another person because a purchaser publicly displayed or voluntarily distributed the ticket's unique admission information.
18. Lost, Stolen, or Inaccessible Tickets
If you cannot locate or access a ticket, contact the Patriot Hall Box Office. Patriot Hall may attempt to verify the transaction and provide assistance when reasonably possible.
Verification may require: purchaser name; email address; order number; transaction information; or other identifying details.
Replacement or reissuance may not always be possible, particularly where Patriot Hall cannot reasonably verify ownership or where the ticket is controlled by an independent third-party ticketing provider.
19. Transfer and Resale of Tickets
A purchaser may not use Patriot Hall tickets in a fraudulent or unlawful manner. Tickets may not be: counterfeited; duplicated for multiple admissions; altered to misrepresent their validity; obtained using fraudulent payment information; used as part of an unauthorized commercial promotion in violation of applicable terms; or resold in violation of applicable law or event-specific restrictions.
Certain events may impose additional transfer or resale restrictions. Any such restrictions should be identified on the applicable event page, ticket, transaction terms, or other event communication.
20. Refunds
Refund eligibility may vary by event. Any refund policy specifically stated on an event page, checkout page, ticket, registration, written agreement, or event communication will control for that event.
Unless otherwise stated, ticket purchases should generally be considered final once a valid transaction is completed. However, Patriot Hall may authorize a refund when appropriate because of circumstances including: event cancellation; event postponement; event rescheduling; material transaction error; duplicate payment; documented system error; event-specific circumstances; administrative determination; or another circumstance in which a refund is required by applicable law.
The availability of a refund in one circumstance does not require Patriot Hall to provide refunds in unrelated circumstances.
21. Event Cancellations
If an event is canceled and will not be rescheduled, Patriot Hall will determine the appropriate treatment of tickets sold through Patriot Hall's authorized ticketing system. Depending upon the circumstances, this may include: automatic refunds; refunds requested through a specified process; ticket credits where offered and accepted; other remedies communicated to purchasers; or treatment required by applicable law.
Patriot Hall will communicate material cancellation information through reasonable available channels. Purchasers are responsible for maintaining a current email address or other applicable contact information.
22. Postponed or Rescheduled Events
An event may occasionally be postponed or rescheduled because of circumstances such as: performer availability; illness; weather; production issues; emergency conditions; public safety; facility conditions; or other circumstances.
When an event is rescheduled, previously issued tickets may remain valid for the replacement date unless Patriot Hall announces otherwise. Patriot Hall may establish a specific refund window or other options for a rescheduled event. The options announced for that particular event will control.
23. Changes to Performers, Programs, or Event Content
Performers, speakers, programs, schedules, supporting acts, production elements, and event content may change. A change that does not constitute cancellation of the event does not automatically create a right to a refund unless Patriot Hall or the event-specific policy provides otherwise.
Patriot Hall will attempt to communicate significant event changes when reasonably practical.
24. Service and Processing Fees
A refund may or may not include originally charged service, transaction, or processing fees depending upon: the event; the circumstances of the refund; third-party processing arrangements; what was disclosed at purchase; and applicable law.
Any event-specific refund notice will control where it addresses fees.
25. Travel and Incidental Expenses
Unless otherwise expressly agreed in writing, Patriot Hall is not responsible for independent expenses a patron incurs in connection with attending an event, such as: transportation; fuel; lodging; meals; parking outside Patriot Hall control; childcare; or other incidental costs.
This provision does not limit any right or remedy that cannot lawfully be limited.
26. Event Entry
Admission to an event is subject to: possession of a valid admission credential where required; applicable event rules; venue rules; safety requirements; capacity limits; lawful instructions from authorized personnel; and compliance with applicable law.
Possession of a ticket does not authorize conduct that threatens safety, disrupts an event, damages property, interferes with performers or patrons, or violates law.
27. Event and Venue Conduct
Visitors are expected to conduct themselves in a safe and respectful manner. Conduct that may result in intervention, refusal of entry, removal, or other appropriate action includes, as applicable: violence or threats of violence; fighting; harassment; intentionally disruptive behavior; damaging County or third-party property; interfering with emergency personnel; unauthorized access to restricted areas; intentionally obstructing aisles or exits; tampering with safety equipment; fraudulent ticket use; interfering with a performance or presentation; refusal to comply with lawful safety instructions; conduct prohibited by law; or other behavior that creates a material safety or operational concern.
Patriot Hall personnel may contact law enforcement or emergency services when appropriate.
28. Prohibited and Restricted Items
Patriot Hall may prohibit or restrict items based upon: applicable law; public safety; event requirements; performer requirements; security considerations; building requirements; or posted venue policies.
Requirements may differ between events. Where an event has special restrictions, Patriot Hall may publish them on the event page, communicate them before the event, or post them at the facility.
29. Security Screening
Patriot Hall may implement reasonable security measures for an event or facility area. Security measures may vary based upon the event and circumstances.
Entry may be conditioned upon compliance with lawful and appropriately posted security procedures. Persons who refuse an applicable security requirement may be denied entry where permitted by law and policy.
30. Security Cameras
Security cameras operate inside Patriot Hall. Visitors may therefore be recorded while present in monitored areas of the facility.
Security systems are used for purposes such as: public safety; protection of persons; protection of County property; incident investigation; theft prevention; security; enforcement of facility rules; and other authorized governmental purposes.

31. Emergency and Safety Instructions
In an emergency or safety situation, visitors must follow instructions from: Patriot Hall personnel; Sumter County personnel; law-enforcement officers; fire personnel; emergency medical personnel; or other authorized emergency responders.
Patriot Hall may interrupt, delay, relocate, evacuate, or end an event when reasonably necessary for public safety.
32. Accessibility
Patriot Hall is committed to providing access to its programs, services, and facility consistent with applicable law. Individuals who require assistance or an accommodation are encouraged to contact Patriot Hall sufficiently in advance when possible.
Patriot Hall may need reasonable information concerning the accommodation requested but generally does not require detailed medical information through ordinary website forms. Accessibility questions may be directed to Patriot Hall Administration or the Box Office.
33. Service Animals
Patriot Hall will address service-animal access in accordance with applicable law and Sumter County policies. Animals that do not qualify for access under applicable law may be subject to venue restrictions.
Event-specific or facility rules may contain additional information where appropriate.
34. Children and Youth Events
Patriot Hall hosts programs and events involving children and teenagers. Parents, legal guardians, teachers, school representatives, camp representatives, and group coordinators remain responsible for supervision of minors to the extent established by the applicable program or group arrangement.
For organized school, camp, or group activities, Patriot Hall generally coordinates administrative information through the responsible adult representative rather than collecting unnecessary individual student information.
35. Event Photography and Video
Photography, video recording, and other media capture may occur at Patriot Hall events. Patriot Hall may photograph or record: performances; audiences; public events; community programs; educational activities; facility activities; and other events, for purposes including: public information; documentation; marketing; social media; community outreach; news; historical use; archives; and promotion.
Visitors attending public events may incidentally appear in photographs or video. Patriot Hall may display signage or event-specific notices regarding photography and recording.
36. Youth Photography and Video
Photography and filming may also occur at youth, school, camp, or student events unless the applicable event, school, group organizer, program, or Patriot Hall specifically states otherwise.
When specific releases, restrictions, or permissions are required, Patriot Hall may coordinate those requirements through the responsible school, organization, parent, guardian, or group representative.
37. Patron Photography and Recording
The ability of patrons to photograph or record an event may vary. Restrictions may be imposed because of: artist requirements; licensing restrictions; copyright; performer agreements; safety; production requirements; privacy considerations; or event-specific policies.
A ticket does not automatically grant the holder the right to professionally photograph, livestream, reproduce, record, or commercially exploit a performance. Visitors must comply with event-specific photography and recording rules.
38. Facility Rentals
Submitting an online rental inquiry does not by itself reserve Patriot Hall or create a binding rental agreement. A rental is not confirmed until the requirements established by Patriot Hall and Sumter County have been satisfied.
Depending upon the rental, those requirements may include: submission of an application; review and approval; execution of a rental agreement; payment of required fees or deposits; proof of insurance; submission of event information; satisfaction of security requirements; compliance with capacity requirements; receipt of required permits; and other applicable conditions.
Rental availability shown on a webpage or discussed during an inquiry remains subject to confirmation.
39. Rental Agreements Control
Facility renters may be required to enter into a separate agreement with Sumter County or Patriot Hall. The rental agreement may address matters such as: payments; deposits; cancellations; damages; insurance; security; food service; alcohol where applicable; vendors; setup; cleanup; technical services; equipment; staffing; occupancy; event hours; prohibited activities; indemnification; legal compliance; and other rental responsibilities.
Where the rental agreement conflicts with these general website Terms, the rental agreement controls with respect to the rental.
40. Rental Inquiry Information
Information submitted as part of a rental request must be materially accurate. Patriot Hall may rely upon information such as: anticipated attendance; event type; setup requirements; technical requirements; event schedule; and requested activities, when determining whether a proposed event can be accommodated.
A material change to the nature or size of a proposed event may require additional review.
41. Outside Event Organizers
A renter, promoter, producer, vendor, performer, or outside organization using Patriot Hall is responsible for its own representations, products, services, and independent business activities.
The fact that an event takes place at Patriot Hall does not mean Sumter County endorses every statement, viewpoint, product, service, sponsor, vendor, performer, or organization associated with that event. Use of a public facility by an outside organization should not be interpreted as governmental endorsement unless Patriot Hall or Sumter County expressly states otherwise.
42. Outside Event Data
Patriot Hall does not provide individual patron contact lists to outside renters or promoters for their independent marketing. Patriot Hall may provide appropriate aggregated or operational reports such as: tickets sold; revenue; capacity; attendance; refunds; and settlement information.
Privacy practices concerning ticket and patron information are described in the Privacy Policy.
43. Guest Wi-Fi
Patriot Hall may provide guest Wi-Fi through systems operated or monitored by Sumter County Government. Guest Wi-Fi is provided as a convenience and may be: interrupted; limited; monitored for security purposes; filtered; unavailable; or modified.
Use of County-managed networks may generate technical and security logs. Users should not assume public Wi-Fi provides the same privacy or security as a private network under their control.
44. Acceptable Use of Guest Wi-Fi
Users of guest Wi-Fi may not knowingly use the network to: violate applicable law; attempt unauthorized access to County systems; distribute malicious software; interfere with network operations; conduct attacks against other systems; circumvent security controls; engage in fraudulent activity; or materially impair use of the network by others.
Sumter County may restrict or terminate network access when reasonably necessary for security, operational, or legal reasons.
45. Acceptable Use of the Website
You may not misuse the Site. Prohibited activities include attempting to: gain unauthorized access to Site systems; bypass account or security controls; introduce malicious code; transmit malware; interfere with Site operations; overload Site infrastructure; scrape the Site in a manner that materially impairs operations; use automated systems to commit fraud; manipulate ticket inventory; interfere with another user's account; impersonate another person; submit fraudulent transactions; obtain unauthorized access to personal information; probe systems for vulnerabilities without authorization; or use the Site for unlawful activity.
46. Automated Access
Patriot Hall may use technical measures to protect ticket inventory, accounts, forms, and other services against excessive or abusive automated access. Automated access that materially interferes with Site operations, attempts to evade security controls, or is used for fraudulent ticket acquisition may be restricted.
This provision is not intended to prohibit ordinary search-engine indexing, accessibility technologies, or other legitimate uses that do not impair Site operations.
47. User Submissions
The Site may allow users to submit: contact messages; inquiries; rental information; documents; photographs; comments; feedback; application materials; or other content.
You retain whatever ownership rights you lawfully possess in materials you submit unless another agreement provides otherwise. Submitting material to Patriot Hall does not give Patriot Hall ownership of your private content merely because it was submitted through a form.
However, you authorize Patriot Hall and Sumter County to use, reproduce, store, transmit, review, and process submitted material to the extent reasonably necessary to: respond to your request; administer a transaction; evaluate a rental; operate a program; maintain governmental records; comply with law; or perform the purpose for which the information was submitted.
48. Publicly Submitted or Promotional Material
If you knowingly provide photographs, testimonials, promotional materials, event graphics, descriptions, or similar content to Patriot Hall for publication or promotion, you represent that you have sufficient rights to authorize the intended use.
Unless otherwise agreed in writing, you authorize Patriot Hall to reproduce, display, resize, format, and distribute those materials as reasonably necessary for the agreed event, program, website listing, or promotional purpose. This provision does not transfer ownership of the original intellectual property to Patriot Hall.
49. Intellectual Property
Unless otherwise indicated, content created by or for Patriot Hall on the Site may include materials protected by copyright, trademark, or other intellectual-property laws, such as: logos; graphics; photographs; videos; text; designs; layouts; event materials; promotional content; and other creative works.
Some content belongs to artists, performers, renters, photographers, licensors, Wix, or other third parties and is used with authorization or under applicable law.
50. Permitted Use of Website Content
Users may access and use the Site for ordinary personal, informational, educational, community, and transactional purposes.
Unless authorized by law or permission, users may not use Site content in a way that falsely suggests: endorsement by Patriot Hall; endorsement by Sumter County Government; sponsorship by Patriot Hall; partnership with Sumter County; or governmental approval.
51. Government Information and Public Records
Nothing in these Terms is intended to restrict rights that members of the public possess under the South Carolina Freedom of Information Act or other applicable public-record laws.
Requests for governmental records should be made through the appropriate Sumter County records process. The fact that information appears on the Site does not alter its legal status as a public record, copyrighted work, exempt record, or other governmental information.
52. Third-Party Links
The Site may contain links to websites or services operated by third parties, such as: Stripe; Wix; Google; Facebook; Instagram; Sumter County services; reservation systems; performers; presenters; partners; mapping services; vendors; and other organizations.
A link does not necessarily constitute endorsement. Patriot Hall does not control independent third-party websites and is not responsible for establishing their terms, privacy practices, content, availability, or security.
53. Third-Party Services
Certain Site functions depend upon third-party technology. Use of those functions may also be subject to terms established by the third-party provider. For example, payments processed by Stripe are also subject to applicable Stripe terms.
Patriot Hall may change technology providers when appropriate.
54. Social Media
Patriot Hall may operate pages or accounts on third-party social-media services. Interactions occurring through Facebook, Instagram, YouTube, or another social network are also governed by the rules and terms of the applicable platform.
Content posted publicly on social media may be visible to other users. Patriot Hall may moderate content on official Patriot Hall pages consistent with applicable law and governmental policy.
55. Website Security
Users may not attempt to defeat or circumvent Site security. Patriot Hall may: investigate suspicious activity; preserve relevant logs; restrict access; suspend accounts; notify Sumter County technology personnel; contact service providers; or refer suspected criminal activity to law enforcement, when reasonably necessary.
56. Fraud
Patriot Hall may cancel or investigate transactions that reasonably appear to involve: stolen payment credentials; chargeback fraud; unauthorized account use; falsified information; counterfeit tickets; automated abuse; identity misuse; or another suspected fraudulent activity.
Any such action will be subject to applicable law and appropriate governmental procedures.
57. Disclaimers Regarding Website Content
The Site and its informational content are provided for public information and operational convenience. Patriot Hall makes reasonable efforts to keep information accurate but does not warrant that every webpage will at all times be: error-free; complete; uninterrupted; current; free from technical problems; or suitable for every particular purpose.
Nothing in this section limits an obligation or liability that cannot lawfully be limited.
58. No Guarantee of Third-Party Performance
Patriot Hall cannot guarantee the uninterrupted operation of independent services provided by companies such as: internet providers; payment processors; website vendors; email providers; telecommunications providers; or social-media platforms.
Patriot Hall will make reasonable efforts to address problems affecting services under its control.
59. Governmental Liability and Immunity
Patriot Hall is operated as part of Sumter County Government. Nothing in these Terms is intended to: waive governmental immunity; expand Sumter County's legal liability; waive any defense; waive any statutory limitation; create a cause of action that would not otherwise exist; or create liability beyond that authorized by law.
Claims involving alleged torts of Sumter County, Patriot Hall, County employees, or County agents are subject to applicable law, including the South Carolina Tort Claims Act, S.C. Code Ann. § 15-78-10 et seq.
The rights, immunities, limitations, defenses, procedures, exemptions, and protections available to Sumter County and its employees under applicable law are expressly preserved.
60. No Waiver of Legal Rights
Nothing in these Terms is intended to waive: sovereign or governmental immunity; statutory protections; statutory damages limitations; public-record exemptions; evidentiary privileges; defenses; procedural requirements; jurisdictional requirements; or other legal protections available to Sumter County or Patriot Hall.
Similarly, nothing in these Terms is intended to eliminate a consumer, civil, accessibility, or other legal right that cannot lawfully be waived.
61. Responsibility for Unlawful or Unauthorized User Activity
To the extent permitted by applicable law, a person or organization that uses the Site to engage in fraud, infringement, unlawful conduct, or an unauthorized submission is responsible for the consequences of that conduct, including any resulting loss, cost, or liability to Patriot Hall or Sumter County arising directly from it.
Any indemnification or risk-allocation obligations applicable to a facility renter, vendor, promoter, contractor, or other contractual party will be governed primarily by the applicable written agreement with Sumter County or Patriot Hall.
62. Governing Law
These Terms are governed by the applicable laws of the State of South Carolina and the United States. Matters concerning Sumter County Government remain subject to the laws governing South Carolina political subdivisions.
To the extent a dispute may lawfully be brought in court and no other venue is required by law, an appropriate court having jurisdiction over Sumter County, South Carolina, may serve as the forum for the matter.
Nothing in this provision constitutes consent by Sumter County to a lawsuit, jurisdiction, remedy, or cause of action for which consent does not otherwise exist under applicable law.
63. Public Records
Communications and materials received or maintained by Patriot Hall in connection with public business may constitute public records under South Carolina law.
Users should not assume that information submitted to Patriot Hall will remain confidential merely because it was submitted through a website form, email, an online account, a rental application, or another electronic process.
Applicable exemptions, privileges, confidentiality requirements, and redaction provisions remain available as provided by law. See the Privacy Policy for additional information.
64. Records Retention
Electronic transactions, user communications, rental records, ticket records, security information, and other records may be retained in accordance with: South Carolina Department of Archives and History retention schedules; Sumter County records-management requirements; County policies; financial requirements; audit requirements; contractual requirements; litigation holds; investigations; security needs; and other applicable law.
Closing an account or withdrawing a request does not necessarily require destruction of a governmental record.
65. Changes to These Terms
Patriot Hall may revise these Terms as operations, technology, services, policies, laws, or regulations change. The current version will be posted on the Patriot Hall website. The date at the beginning of these Terms identifies the most recent revision. Material changes may receive additional notice when appropriate.
Changes will apply prospectively to use of the Site after the revised Terms become effective, except where another implementation date is stated or applicable law requires otherwise.
A previously executed rental contract or other specific written agreement is governed by the terms applicable to that agreement unless it is lawfully amended.
66. Suspension or Termination of Website Access
Patriot Hall may restrict or terminate access to an account or Site feature when reasonably necessary because of: fraud; security concerns; unlawful conduct; material violation of these Terms; repeated misuse; threats to Site operation; governmental security requirements; or discontinuation of a service.
Patriot Hall may preserve records associated with the account as required by law or governmental records-retention requirements.
67. Severability
If a provision of these Terms is determined by a court of competent jurisdiction to be unlawful or unenforceable, the remaining provisions should remain in effect to the extent permitted by law.
An unenforceable provision should be interpreted or limited only to the extent necessary to comply with applicable law.
68. No Waiver by Non-Enforcement
If Patriot Hall does not immediately enforce a provision of these Terms in a particular circumstance, that does not necessarily constitute a permanent waiver of the provision.
Any waiver by Sumter County or Patriot Hall must be authorized as required by applicable law and County policy.
69. No Third-Party Beneficiaries
Unless a specific agreement expressly provides otherwise, these Terms do not create contractual rights for third parties who are not parties to the relevant transaction or agreement.
70. Relationship to Other Policies
These Terms should be read together with: the Privacy Policy; applicable event-specific policies; applicable ticket conditions; applicable rental agreements; applicable facility rules; applicable accessibility information; applicable cookie notices; and other policies or agreements expressly applicable to a particular service.
71. Contact Form Acceptance
Where a Patriot Hall form asks you to acknowledge these Terms, checking the applicable box confirms that you have had an opportunity to review the Terms.
Acceptance of these Terms does not require you to surrender rights granted to you by applicable law. A general Contact Us form should not be used to submit highly sensitive personal information.
